WAIVER & RELEASE OF LIABILITY (FLORIDA)
Guardian Authority
The undersigned (“Guardian”) represents and warrants that they are the parent /natural or court‑appointed legal guardian of the minor participant (“Minor”), as defined in Florida Statute §744.301(1), and have full authority to execute this agreement on the Minor’s behalf.
Inherent Risks
Florida Statute §744.301(3)(a) defines “inherent risks” as dangers or conditions, known or unknown, that are characteristic of and integral to an activity and cannot be eliminated even with reasonable care. These risks include, but are not limited to, the failure to warn of such risks and the possibility that participants may act negligently or intentionally, causing loss, injury or damage.
Assumption of Risk & Notice
The Guardian acknowledges that participation involves inherent risks and voluntarily allows the Minor to participate after reading and understanding this waiver. By signing electronically or otherwise, the Guardian knowingly gives up the right, on behalf of the Guardian, the Minor, and any chaperone, to sue for injuries or property damage resulting from inherent risks of the activity.
Release of Liability
In consideration for participation in programs or sessions provided by The Arts Corner/The Arts Corner KIDZ Network Inc.(“Provider”), the Guardian, on behalf of themselves, the Minor, and their respective heirs and assigns, releases and forever discharges the Provider and its owners, officers, employees, affiliates, and agents from any and all claims for injury, loss, or death arising out of participation, including claims based on ordinary negligence, whether occurring on‑site or off‑site, now or in the future.
Binding Effect & Capacity
This agreement is binding on the Guardian, the Minor, any chaperone, and their heirs and assigns. The Guardian affirms they are of sound mind, have read and understand this agreement, and execute it voluntarily and knowingly.
Jury Trial Waiver
The Guardian knowingly and voluntarily waives the right to a trial by jury in any action or legal proceeding arising out of or relating to this Waiver, the Minor’s participation, or the activities of the Provider. The Guardian understands and agrees that any such claim will be resolved by a judge sitting without a jury (a “bench trial”), who will decide all
Severability
If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall continue in full force and effect. on behalf of the Minor.
